" The lawyer for the suspected Craigslist killer is not pulling any punches he is back in a Boston courtroom today. Ask if the media influenced the grand jury's decision to indict Philip Markoff. CN's Brad Crawford joins us from Boston with more good afternoon Brad."
" Well good afternoon -- is certainly be interesting to see how far his defense attorney gets ripped at this motion and with this hearing. Yesterday Markoff pleaded not guilty to a seven count indictment which includes the murder. Until this embarrassment on April 10 at the Marriott Copley hotel a woman he allegedly met through Craig's list. But today -- us attorney will be backing court arguing that leaks about the evidence has tainted the case fueling pretrial publicity. Defense attorneys want to know what prosecutors know about those -- and what steps they took to protect the secrecy of the grand jury which is supposed to be confidential. But NEC and legal analyst Randy Chapman says the defense will have a hard time proving that the grand jury process was compromised."
" I think he's trying to just raise an issue to put the prosecution back on the heels a little bit. So that -- least they'll think twice about possibly disseminating information. That may compromise his client's right to a fair trial at a later point. There's really very little precedent for the charges in the case that it is being dismissed because there has been some type of grand jury leak. And from we haven't heard anything that would indicate that the government is anyway orchestrated these --"
" And Chapman says unlike a trial jury a grand jury can. Take into account a lot of information including hearsay information that a trial jury cannot so there's a lot of leeway there. The prosecution. Says they won't make their statements in the courtroom and certainly we'll have a full wrap up of that hearing later this afternoon."
" attorneys gathered there today and I understand that a lawyer for Mark Cox ex fiance spoke as well."
" That's right he spoke to Good Morning America this morning and essentially said that Megan McAllister his ex fiancee last saw. Philip Markoff a two weeks ago here in Boston. And essentially told him that she was about to start medical school herself you'd be pursuing that and wouldn't be back to Boston and didn't expect to see him. Perhaps ever again."
" All right Fred -- reporting from Boston thank you."
